TERMS OF SERVICE

1. Introduction
Welcome to Shape Shifter Fitness LLC (“SSF,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our coaching programs, digital products, platforms, and related services (collectively, the “Services”).

By enrolling in a program, purchasing a product, or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

2. Scope of Services
2.1 Coaching Services
SSF provides fitness and lifestyle coaching services which may include, but are not limited to:
- Customized workout programming
- Nutrition guidance and meal planning
- Mindset and habit coaching
- Accountability systems and check-ins
- Progress tracking
- Services may be delivered via EverFit, Zoom, Discord, email, or other communication platforms.

2.2 Digital Products
SSF may offer digital products including guides, PDFs, workouts, and meal plans. Digital products are self-guided, do not include coaching, and are non-refundable once accessed or downloaded.

3. Payments, Refunds & Cancellations
3.1 Payments
Full payment or the first installment is required before program access is granted. If a payment plan is selected, the client agrees to complete all scheduled payments, regardless of participation, results, or circumstances. Financing options (Affirm, Klarna, Afterpay, etc.) are third-party agreements. SSF does not control billing, approvals, or financing terms.

3.2 Refund Eligibility (No Program Access)
A client may request a full refund only if ALL of the following conditions are met:
- Payment has been made
- The client has NOT accessed any coaching materials, including but not limited to:
- EverFit login credentials
- Workouts, nutrition plans, PDFs, or documents
- Dashboards, check-ins, or progress tracking
- The client has NOT started the program, meaning:
- No onboarding has occurred
- No materials have been delivered
- No coach interaction has taken place
- If all conditions above are met, the client may be eligible for a full refund upon written request.

3.3 Pre-Start Cancellation With Material Access
Clients may cancel their enrollment before the official program start date. If the client has accessed any coaching materials before the start date, the client is eligible for a 50% refund only. Accessing coaching materials constitutes partial service delivery and program initiation.

3.4 No Refunds After Program Start
Once the program has started, no refunds will be issued. The program is considered started when any of the following occurs:
- Login credentials are provided
- EverFit access is granted
- Coaching materials are delivered
- A coach engages with the client
- Workouts, nutrition plans, or check-ins are issued
- Lack of participation, change of mind, personal circumstances, scheduling conflicts, or financial hardship do not qualify for a refund.

4. Program Pauses (Medical Only)
Program pauses do not constitute refunds or cancellations. A pause may be granted only for documented medical necessity. Documentation must be provided by a licensed MD or DO only. Maximum pause duration is 60 days, unless extended in writing by SSF. Program time is paused, but payments continue as scheduled. All pauses are governed by the SSF Program Pause Addendum and Medical Program Pause Clearance Form.

5. Client Responsibilities
Clients agree to:
- Follow prescribed workout and nutrition guidelines
- Complete required check-ins based on program tier
- Communicate honestly and promptly
- Use assigned platforms as instructed
- SSF is not responsible for lack of results due to non-compliance.

6. Coach Assignment
SSF reserves the right to:
- Assign or reassign coaches at any time
- Modify delivery methods or schedules
- Coach changes do not qualify for refunds or cancellations.

7. Intellectual Property
All coaching materials, plans, videos, documents, and digital products are the exclusive intellectual property of Shape Shifter Fitness LLC. Clients may not copy, share, reproduce, distribute, or resell any materials. Violations may result in immediate termination and legal action.

8. Health & Liability Disclaimer
Participation involves inherent physical risks. SSF does not provide medical advice. Clients are responsible for consulting a healthcare professional before beginning any program. SSF is not liable for injuries, medical conditions, or adverse outcomes. Results are not guaranteed.

9. Termination of Services
SSF reserves the right to terminate access if a client:
- Violates these Terms
- Engages in abusive, inappropriate, or dishonest behavior
- Attempts unauthorized chargebacks or payment disputes
- Termination does not relieve payment obligations.

10. Chargebacks & Payment Disputes
Clients agree to:
- Contact SSF directly to resolve billing issues
- Avoid initiating chargebacks without written resolution attempts
- Unauthorized chargebacks will result in:
- Immediate termination
- Loss of access
- Potential legal recovery actions

11. Recording & Communications
Clients consent to the recording of calls, video sessions, and communications for quality assurance, documentation, and training purposes.
Recordings remain confidential unless written consent is provided for marketing use.

12. Governing Law & Arbitration
These Terms are governed by the laws of the State of Florida. All disputes shall be resolved through binding arbitration in Florida, under the rules of the American Arbitration Association. Each party bears its own costs.
